Filing boundary
Burundi has no universal immigration, nationality, protection, employment, consular, payment or submission channel. Law 1/25 of 5 November 2021 is current and repeals the 1989 migration decree-law and 2008 asylum law. Older PAFE-labelled pages, forms, categories, fees and indefinite-residence concepts require current-law confirmation. Finance published secured-residence-card orders on 25 February and 4 May 2026. The later order appears controlling, but its full text, effect, commencement, fees, card classes and evidence rules remain unverified; activate no residence workflow until reconciled. MFA, Police, ISOKO and mission materials conflict. Central guidance allows transit visas at entry points; Police describes host-authorisation and airport issuance; Abuja says airport issuance should serve people without mission access; Ottawa says it is impossible. Nationality, visa class, competent post, route, date and current notice control. Infer no universal airport, on-arrival, post, email, courier, transfer or cash route. Mission fees, currencies, payment, passport handling and times differ; never hardcode them or any bank account, validity or refund rule. A Police permanent-resident-visa document describes a two-year renewable document while MFA uses other terms; it proves no indefinite residence, work authority or citizenship. Employment requires the 2020 Labour Code and 2022 foreign-worker and EAC order. The repository still labels the superseded 1993 Code in force; the 2020 Gazette controls. Employer reporting, status, tax and workforce-ratio duties remain separate. The 2000 Nationality Code is listed in force, but UNHCR says it is being updated. Naturalization is discretionary, applicant-signed and completed by presidential decree; person-specific decrees are decisions, not reusable forms, entitlements or channels. Burundi is party to the 1951 Refugee Convention, reserved 1967 Protocol and 1969 OAU Refugee Convention. UN and UNHCR show no party status under the 1954 or 1961 statelessness conventions. Assembly adoption and Senate-pending accession bills are not accession. ONPRA's name includes stateless persons, but no complete public determination channel was verified. Current asylum practice follows the 2021 law, 2022 ONPRA, CCER and appeal decrees and live UNHCR guidance. Intent is declared at the border or within 30 days; CGM pre-screening, fingerprints and retinal biometrics, ONPRA registration, interviews, testimony and decision collection are personal or authority-controlled. Since February 2024, core processing occurs at named transit centres after intake and transfer. A representative may accompany a claimant after ONPRA notice but cannot replace personal stages. The 20-day appeal and free process require human review; solicit no RSD fee. Lawyer or Bar status is not generic immigration authority. Procuration for a visa-of-stay or criminal-record request does not authorize other filings, credentials, signatures, biometrics, passport surrender, border inspection, oaths or collection. The MFA browser form requests an appointment, not full submission. The 1980 family code is repealed; use the 1993 reform plus 1999 and later amendments. Law 1/05 of 30 April 2026 is the latest social-protection amendment layer, not a replacement for the 2020 and 2022 chain. BRB describes a draft collateral-registry decree and planned system, not an operational registry; no verified public beneficial-ownership register was found. EasyBusiness, OBR connected space and ARCT are credentialed portals, not public APIs. Browser forms, email, counters, transfers, cash and databases establish no machine-submission, bulk-status, payment, decision or monitoring API. The 2024 Electronic Communications Code excludes family and succession matters, court representation or assistance, and notarial acts; e-sign use is route-specific. Burundi has been an Apostille Convention party since 13 February 2015, but objections affect Austria, Germany, the Czech Republic and Poland. ESAAMLG says Burundi awaited mutual evaluation; do not invent a current report. Official bodies establish register responsibility, but no searchable public lawyer, accountant or notary roll was verified. Gazette PDFs are issue-level and require later-amendment reconciliation. Credentials must not be shared or automated. Identity, consent, originals, translations, legalisation, signatures, appearance, biometrics, interviews, checks, border admission, payment authority, passport handling, oath, decision and collection remain actor- or authority-controlled. No source monitoring is configured; review is manual only. Every matter requires current route, authority, post, actor, account, source health, edition, fee and personal-stage confirmation. This research-only release activates no pathway, eligibility decision, form-preparation pack, source monitoring, fee engine, representative filing, portal action, payment, transmission, legal advice, or government submission.
Representative participation
Representation is route-, authority-, actor-, account- and personal-stage-specific. Law 1/17 of 24 July 2023 limits professional practice to regularly enrolled lawyers; a foreign lawyer may be authorized to appear before a Burundian court only with the favourable opinion of the competent Bar council. Those rules concern legal and court representation and do not create a general immigration, nationality, asylum, consular, payment or portal-filing entitlement. UNHCR's current Burundi asylum guidance says a claimant may be accompanied by a legal representative if ONPRA is informed so arrangements can be made; the claimant must still complete personal declaration, pre-screening, biometric enrolment, registration, RSD or appeal interviews and decision collection. The Police visa-of-stay page says that route's request may be made by procuration, and the criminal-record procedure also permits procuration; neither statement extends to other routes. Employer, host, spouse, parent, organization, mission, counsel and applicant roles remain distinct. Confirm mandate, Bar standing, authority acceptance, signature, originals, account holder, payment authority and personal attendance for every action. Never share applicant, employer, sponsor, representative, mission, portal or payment credentials.
