INA definitions of State and United States include Guam, so federal immigration and nationality law controls. 8 USC 1407 generally grants citizenship to persons born in Guam on/after 1899-04-11 subject to U.S. jurisdiction, with historic pre-1950 and opt-out rules; do not default residents to non-citizen nationals. Guam is outside the U.S. customs territory and separately administers customs and mirror income tax; immigration, customs and tax treatment are not interchangeable. The Guam-CNMI Visa Waiver Program permits eligible B visitor travel solely in Guam/CNMI for at most 45 days. Recheck nationality, suspension, Hong Kong/Taiwan document, identity, residence, origin, routing and re-entry conditions on the action date. eTA has been mandatory under 8 CFR 212.1(q) since 2024-11-29; a carrier bulletin's 2024-11-30 CHST date is transition provenance only. eTA permits travel to seek admission, not admission or admissibility; CBP decides. Program admission permits no work or onward travel to the rest of the United States. Ordinary change or extension is generally barred; narrow adjustment exceptions need human legal review. Satisfactory departure is discretionary emergency relief of at most 15 days, not an extension. A protection claim can lead to asylum-only proceedings limited to asylum, statutory withholding and CAT. Never import CNMI-only EVS-TAP for PRC nationals, the CNMI asylum restriction through 2029-12-31, CW-1, CNMI investor/resident statuses, CNMI travel rules or Saipan routing. The pre-2009-11-28 Guam 15-day waiver/I-736 is superseded. Russian visitor parole ended 2019-10-03. General parole under 8 USC 1182(d)(5) is case-specific and is not admission, status, work authorization or a visitor substitute. Guam asylum/removal uses federal law; verify any G-CNMI asylum-only posture. Honolulu Immigration Court controls the Hagatna hearing location; it is not a standalone administrative filing court. The case notice controls; do not hardcode an asylum office or address. The District Court of Guam is not the initial merits forum. Work authorization is category-specific under 8 CFR 274a.12; a G-CNMI visitor cannot work. Guam H-2B is employer-led: Guam labor certification and a federal petition/admission are separate; no worker self-filing. Guam/CNMI H cap and H-2B temporary-need exceptions are narrow. Under 48 USC 1806(b)(1)(B), admission must occur before 2029-12-31 and may last up to three years. Pub. L. 119-60 section 1703 separately covers qualifying military-installation construction, repair or renovation on Wake Island, including transfer from Guam under section 1806(b)(1); the admission window lets an alien seek admission through 2030-12-31 and an authorized period may last up to three years. Verify contract, worker, place, date and instructions. Guam DOL electronic-filing authorization covers monthly reports only, not labor certification, USCIS petitions or Wayfinder submission. Eligible FSM, RMI and Palau Compact citizens may live/work after qualifying admission, but verify citizenship, class and evidence; Compact admission is not permanent residence. Guam or IRS tax filing depends on residence, source, status and other facts; do not auto-select a return. Guam is not a separate treaty party. For each treaty verify U.S. status, territorial scope, declarations and implementing law; treaty status alone creates no benefit, form, channel or API. Recheck law, territorial scope, status, authority/forum, actor/account, standing, form, evidence, signature, fee, channel, deadline, service and review on the action date. Public forms and portals are route-limited and do not authorize Wayfinder to select a benefit, control an account, share credentials or OTPs, sign, pay, file, receive service, poll status, appear or use an API. USCIS clients and representatives use separate accounts; the client retains identity-bound acts and generally signs. No open public filing, payment, standing, mandate, legal-update or reusable case-status API was verified. Automate no login, CAPTCHA, OTP, identity proofing, declaration, signature, payment, appointment, interview, biometric, submission, service, collection, polling, appeal or authority contact. Drafts require source-cited human legal review and matter-owner approval; only an authorized human uses the live official channel. Representative participation
Representation is route-, forum-, territory-, actor-, account-, standing-, mandate-, date-, form- and stage-specific. For federal immigration, verify the attorney is validly licensed and in good standing in a U.S. state, possession, territory, commonwealth or D.C. and not under EOIR discipline. Non-attorney representation requires current forum authority. DOJ accreditation through a recognized organization is one route; partial accreditation excludes EOIR. EOIR may also approve limited appearances by qualifying law students or graduates, reputable individuals, certain family representatives and accredited foreign officials under its rules. Guam labor, customs, tax or other territorial-law work may require separate Guam admission or authority. Guam lawyer and EOIR roster and discipline records are verification inputs only; they do not prove identity, current standing, competence, engagement, conflicts clearance, mandate or authority acceptance. Recheck license, standing, discipline, eRegistry and any accreditation and organization link before action. A signed Form G-28 or EOIR-28 and client and case acceptance are required where applicable. Platform membership, workspace access, a scope record or per-matter payment proves no legal authority. USCIS clients and representatives use separate accounts; never share credentials or one-time codes or use the client's account to enter or sign.
